CRITICAL LEGAL NOTICE & EXPERIMENTAL BETA DISCLAIMER:
BrokeSnake is experimental software provided strictly in an open PUBLIC BETA testing phase. The software, game mechanics, scoring algorithms, WebSocket network connections, and Solana blockchain wallet integrations are provided strictly on an "AS-IS", "AS AVAILABLE", and "WITH ALL FAULTS" basis. Unexpected software bugs, glitches, server latency spikes, balance display discrepancies, or disconnections CAN AND DO OCCUR.
PLAY AT YOUR OWN RISK: BY PLAYING, DEPOSITING, OR USING BROKESNAKE IN ANY MANNER, YOU EXPRESSLY AND IRREVOCABLY ACKNOWLEDGE THAT YOU ARE VOLUNTARILY PARTICIPATING IN AN EXPERIMENTAL BETA TEST ENTIRELY AT YOUR OWN RISK. YOU EXPLICITLY WAIVE AND FOREVER DISCHARGE ANY AND ALL RIGHT TO BRING ANY LAWSUIT, ARBITRATION, DISPUTE, OR LEGAL CLAIM OF ANY NATURE AGAINST THE CREATOR(S), OWNER(S), OR OPERATOR(S) OF BROKESNAKE.
1. Binding Agreement & Eligibility (18+ Only)
By creating an account, authenticating via Privy (Email or Google OAuth), sending deposits, or participating in matches on BrokeSnake ("the Service", "the Platform", "we", "us"), you legally confirm and warrant that:
- You are at least eighteen (18) years of age or the age of legal majority in your jurisdiction.
- Skill-based arcade games with entry consideration are legal under your applicable state, provincial, and national laws.
- You are not a citizen or resident of any jurisdiction where skill-based gaming or peer-to-peer crypto transfers are restricted or unlawful.
- You possess the legal capacity to enter into this legally binding agreement.
2. Experimental Beta Phase & "Play at Your Own Risk"
You expressly recognize and agree that:
- BrokeSnake is undergoing continuous development, active refactoring, and real-time stress testing.
- Bugs, unexpected collisions, rendering anomalies, desynchronization between clients, WebSocket dropouts, server restarts, or hosting downtime may impact gameplay or match outcomes.
- No Liability for Beta Bugs: Under no circumstances shall the platform creator, developer, or hosting provider be responsible for losses of score, in-game valuation, entry stakes, or cryptocurrency arising directly or indirectly from bugs, network latency, or browser crashes.
3. Complete Release, Covenant Not to Sue & Class Action Waiver
COVENANT NOT TO SUE: You irrevocably release, forever discharge, hold harmless, and covenant NEVER to initiate, join, prosecute, or participate in any legal action, lawsuit, arbitration proceeding, class action, collective action, private attorney general claim, or regulatory complaint against BrokeSnake, its individual creators, operators, hosting providers, or associates, in any forum worldwide.
Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL CLAIMS AND DISPUTES MUST BE RESOLVED EXCLUSIVELY ON AN INDIVIDUAL BASIS. YOU IRREVOCABLY WAIVE ANY RIGHT TO COMMENCE, JOIN, OR PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
4. Absolute Limitation of Liability & Zero Damages Cap
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATORS, CREATORS, OR CONTRIBUTORS OF BROKESNAKE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF CRYPTO ASSETS, LOST PROFITS, LOST DATA, HARDWARE DAMAGE, OR PERSONAL INJURY.
IF, NOTWITHSTANDING THE FOREGOING WAIVERS, ANY COURT OR TRIBUNAL FINDS LIABILITY ON BEHALF OF THE PLATFORM OR ITS OPERATORS, THE MAXIMUM AGGREGATE LIABILITY FOR ALL CLAIMS COMBINED SHALL BE STRICTLY CAPPED AT ZERO EUROS (€0.00) (OR THE EXACT SINGLE MATCH ENTRY STAKE OF €1.00 ACTUALLY PAID FOR THE DISPUTED ROUND, WHICHEVER IS LESS).
5. Mandatory Indemnification & Hold Harmless
You agree to defend, indemnify, and hold completely harmless BrokeSnake, its individual founders, operators, employees, contractors, and third-party infrastructure services from and against any and all claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees and legal costs) arising out of or related to:
- Your access to or use of the Service;
- Your violation of these Terms of Service;
- Your violation of any applicable local, state, national, or international law;
- Any disputes between you and any other player or third party.
6. Skill-Based Arcade Mechanics & Entry Fees
BrokeSnake is an interactive skill-based arcade competition. Game results are predominantly determined by player reflexes, steering accuracy, trajectory prediction, and tactical decision-making. Matches in the paid arena require a €1.00 entry stake deducted from your verified in-game balance. In-game gains are realized only by skilled elimination of other players and timely cashout. All match entries are final and strictly non-refundable once the countdown completes.
7. Digital Assets & Solana Blockchain Notice
- Non-Custodial External Wallets: BrokeSnake facilitates deposits and withdrawals via the public Solana blockchain network. Cryptocurrencies are volatile digital assets. Deposits do not represent bank deposits, are not fiat currency, and are not insured by any government deposit protection scheme.
- Irreversibility: Transactions on the Solana blockchain are immutable and irreversible. We cannot reverse, cancel, or refund transfers sent to incorrect or fraudulent recipient addresses.
- No Financial Advice: Nothing on BrokeSnake constitutes financial, investment, or legal advice.
8. Fair Play, Anti-Cheat & Prohibited Activities
We enforce a strict zero-tolerance policy against cheating. Prohibited actions include: utilizing automated bots, memory injection, speed hacks, network packet manipulation, multi-accounting to farm balances, or colluding. We reserve the absolute, unilateral right to suspend accounts, ban offending players, and cancel ill-gotten balances without notice.
9. Severability & Entire Agreement
If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
